Terms and Conditions

Welcome to Spotted! These Terms and Conditions ("Terms") govern your access to and use of our photography marketplace platform (the "Platform"), accessible via spotted.com, operated by Spotted Inc.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Use of the Platform

You must be at least 18 years old to use the Platform. By registering, you confirm that all information provided is accurate and that you will keep your account information up to date.

2. User Accounts

  • Registration via email/password or OAuth (Google, etc.) is required.
  • You are responsible for maintaining the confidentiality of your credentials.
  • Any activity under your account is your responsibility.

3. Uploading and Licensing Photos

  • You may upload images that you own or have full rights to distribute.
  • By uploading, you grant us a non-exclusive, worldwide license to display and sell your photos through the Platform.
  • You retain full copyright of your content.

4. Photo Sales and Payments

As a contributor, you set the sale price for each photo you upload. When a customer purchases your photo, the payment is processed via Stripe.

The following fees are deducted from the sale price:

  • Stripe Payment Fee: 1.4% + €0.25 for EU cards (or other rates depending on the card origin).
  • Stripe Connect Fee: 2% platform fee.
  • Spotted App Fee: 20% of the sale price.

After these deductions, the remaining balance is transferred to your connected Stripe account. You are responsible for ensuring your account is correctly set up and verified in order to receive payouts.

Payouts are handled directly by Stripe and may be subject to their standard processing times and requirements.

5. Cloud Storage

  • Uploaded images are stored securely via Cloudinary.
  • We may create and store thumbnails or compressed versions for performance and display purposes.

6. Prohibited Content

You may not upload or distribute content that:

  • Is illegal, pornographic, or promotes violence or hate.
  • Infringes on intellectual property rights.
  • Violates privacy or data protection laws.

7. Intellectual Property

All trademarks, logos, and software are the property of Spotted Inc. or its licensors. Users may not reverse-engineer or exploit the Platform codebase.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or abuse the service.

9. Disclaimers

  • The Platform is provided "as-is" without warranties of any kind.
  • We do not guarantee uninterrupted access, or that the Platform will be free of errors.

10. Limitation of Liability

In no event shall Spotted Inc. be liable for any indirect or consequential damages resulting from the use of the Platform.

11. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be notified via the Platform or email.
